JobCommander, Inc. (“JobCommander”, “we” or “us”) is committed to protecting your privacy. This notice provides you with an understanding of the personal information we collect, and how we collect and use your personal information. In addition, we describe the rights you have in your personal information and your available choices to exercise control over this information. In this Privacy Policy Notice, the term “personal information” means information which you provide to JobCommander which personally identifies you, such as your name, email address or postal address, information provided on your résumé and, in certain circumstances, your location or other data which can be reasonably linked to such information by JobCommander.

Who is JobCommander?
JobCommander develops, licenses, and on-line job placement service to job candidates, recruiters, and employers. JobCommander may refer to itself in this Privacy Policy Notice as JobCommander and in connection with the use of the pronouns “we/us/our.”
Our on-line job placement solutions include the software as a service applications known as the JobCommander® as well as ResumeCommander. These job placement solutions (including all forms and surveys you complete and submit) and web sites listed below are collectively referred to as “the Services.” As a user of the Services, you may receive alerts, notifications, requests for interviews, instructions and information before, during, and after you apply for jobs or post job descriptions using the Services.
You may access the Services located at https:/app2.jobcommander.com/. JobCommander also owns the web sites located at www.jobcommander.com/ and www.resumecommander.com/.
What types of personal information do we collect?
We collect the following personal information, online and offline:
- Contact information – you may provide us with the following information: your name, email and postal addresses, educational and employment history (including educational institutions, dates attended, and degrees awarded), employment history (including positions and dates held, responsibilities, and compensation), landline and mobile telephone numbers. Please note that in order to use certain functions within the Services and receive notifications, mobile phone geolocation information is required.
- Information from public sources – including social media sites and your interaction with them. If you subscribe to certain options and features within the Services, you may receive notifications through your social media apps, email, and accounts.
- Subscriptions & preferences – when you subscribe to receive product, service, or potential employment information, alerts, and updates to help us provide you with information you are interested in receiving from us, as well as notifications through the Services. We also collect information indicating whether you are willing to travel or relocate, as well as your compensation and benefits, work week, and job location preferences (including preferences to work remotely, hybrid, or on-site) in connection with job requirements.
- Online data – the following information may be collected from you when you visit our web sites or use the Services: device type and model, MAC address, IP address, other unique device identifiers, network information, operating system, browser type and version, click stream to, through, and from our web sites, length of visits and interactions on our web pages and emails. We do not collect personal data about your online activities across web sites other than our own. Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a method for users to instruct web sites and certain other services that they do not want certain information about their webpage visits collected over time and across web sites or online services. Please note that we do not respond to or honor DNT preferences or similar instructions transmitted by web browsers. We may provide links to web sites or services of JobCommander’s partners, distributors, suppliers, licensors and other third parties. We do not control the content or links that appear on these third party web sites or services, and we are not responsible for the practices employed by third party websites or services linked to our online or mobile content. These web sites and services are subject to their respective privacy policies and terms of use.
- Attendance data – including your signature, to record your visits to our offices and events.
- Inferences – including your behavior and preferences when you use the Services.
- Employment information – professional and educational background and other information provided in connection with your application for employment with us and/or your application for employment with others using the Services.
- Sensitive personal information – you may choose to provide us with this type of information including disability, dietary, religious, or similar requirements for employment purposes, meetings, and events. If you choose not to provide us with this information, we may not be able to provide you with an accommodation or respond to your needs or preferences. This data will be provided to us by you.
- Criminal record data – where and to the extent permitted by law, and when appropriate under the circumstances. This data will be provided to us by you and/or the organizations who assist us in complying with our legal obligations for screening and regulatory compliance.
Our web sites and the Services are intended to be used by individuals aged 18 and over. We do not knowingly collect personal information from those under the age of 18. If your child or ward under the age of 18 has provided us with their personal information, please contact us at privacy.policy@jobcommander.io so that we may delete the personal information.
How and from whom do we collect your personal information?
- Directly from you – We collect information which you may choose to provide in your communications with us, such as when you request that we send you newsletters, alerts, or other marketing materials; register for a webinar or event; fill out a form; respond to a survey; use the Services; or otherwise communicate or interact with us.
- From other sources – We may receive and collect personal information about you from other sources, including publicly available sources; our affiliated companies; entities to which we provide our products and services such as your employer, recruiters, and other hiring organizations, as well as social media platforms. For example, we may also collect personal information from your social media channels if you choose to link or provide access to them using the Services.
Why do we collect and for what purposes do we use personal information?
We collect your personal information for business and commercial purposes. Our business purposes include providing products and services to you, maintaining security, maintaining and improving the functionality of our products and services, internal research for technological development, pre-employment background checks, post-employment evaluation, benefits and payroll administration, providing employment related notices, equal employment opportunity and other regulatory compliance, compliance with company policy, verification or maintenance of the quality or safety of our products and services, responding to your inquiries, and providing customer service. An example of this would be when you use the Services we collect information about your location, device, and network. We collect and use your personal information to provide you with communications and alerts specific to your career and job interests and job applications.
Commercial purposes include promoting and advancing our commercial or economic interests, such as by soliciting you to buy, rent, lease, license, join, subscribe to, provide, or exchange products, goods, property, information, or services, or enabling or effecting, directly or indirectly, a commercial transaction. This includes sending you newsletters, alerts, and other information that may interest you. Examples of this include our advertising, marketing, and sales efforts in expanding our customer base.
We also use personal information to review and evaluate your employment application and in connection with our employment and on-boarding process. We may use anonymized, pseudonymous, de-identified, or aggregated information so that it will no longer be considered personal information and use and disclose such information as permitted by applicable law.
JobCommander also uses and discloses personal information to comply with the law, including in response to subpoenas, investigations, and civil and criminal proceedings.
With whom do we share your personal information?
JobCommander shares personal information with its service providers, including server and platform hosts, in connection with our provision of products and services to you and other users of the Services, (including other users with whom you choose to interact through the Services), law enforcement, recruiters and employers, other hiring organizations, and their personnel. Information may also be shared with other users of the Services to enable you to interact with other users through the Services. If you created an account to use the Services, other users of your account will have access to your personal information. If JobCommander is acquired or merges with another company, we will share or transfer personal information to the acquiring or surviving company.
We do NOT sell or share your personal information for direct marketing purposes.
How do we protect your personal information?
Transmission of information via the Internet and through our web sites is not completely secure; therefore, we cannot guarantee the security of communications and information transmitted between you and us. After we have received your personal information, we will exercise security procedures to try to prevent unauthorized access. All personal information is stored on secure servers and we employ security policies and procedures to limit and restrict access.
How long do we store your personal information?
We store your information for as long as is needed to provide our Services to you. We also store your information for certain periods of time as required by regulatory, legal and accounting/financial rules. We do not retain personal information or sensitive personal information for each of the disclosed purposes for which the personal information was collected for longer than is reasonably necessary for the applicable disclosed purpose.
What choices are available to you and how do you exercise your choices over how we use or disclose your personal information?

If you are a resident of Colorado, Connecticut, Delaware (effective 1/1/2025), Montana (effective 10/1/2024), New Hampshire (effective 1/1/2025), New Jersey (effective 1/1/2025), Oklahoma (effective 11/1/2024), Tennessee (effective 7/1/2024), Texas (effective 1/1/2024), or Virginia, if required under applicable state privacy law, you also have the right, by sending an email to privacy.policy@jobcommander.io to: (i) opt out of processing of personal information for purposes of profiling in furtherance of decisions that produce legal or similarly significant effects (if such profiling occurs); and (ii) appeal any decision by JobCommander not to take an action relating to your applicable rights.
If you are a resident of Nevada, you may exercise your sale opt-out rights under Nevada Revised Statutes Chapter 603A by submitting a request to privacy.policy@jobcommander.io. However, please know that JobCommander does not currently sell data which comes within the opt-out requirements under Nevada Revised Statutes Chapter 603A.

We may require additional information from you or your agent to verify your identity and the request you submit to exercise your rights.

How will I be informed of changes to this Privacy Policy Notice?
If we decide to change our Privacy Policy Notice, we will post those changes on our web sites so our users are always aware of what information we collect, how we use it, and under which circumstances, if any, we disclose it. This Privacy Policy may be revised from time to time by JobCommander, after giving notice to you, provided that you have registered for an account and have provided us with a valid email address. Alternatively, we will post a prominent notice on our web site. The revised Privacy Policy Notice will be posted by JobCommander on its web sites as it becomes available. Please review the Privacy Policy Notice periodically as it is applicable to all users of the web sites and the Services. You hereby agree to review at first opportunity any modification or revision to the Privacy Policy Notice. If you do not agree to be bound by any modification, you may reject any such change by providing JobCommander written notice of such rejection within 30 days of the date such change became effective, either (a) by mail or hand delivery to our registered agent for service of process, c/o JobCommander, Inc., 10723 Greentrail Drive South, Boynton Beach, FL 33436, or (b) by email from the email address associated with your Account to: privacy.policy@jobcommander.io. In order to be effective, the notice must include your full name and clearly indicate your intent to reject changes to the revised Privacy Policy Notice. By rejecting changes, you shall discontinue your use of the Services, and your license and subscription to the Services shall automatically thereupon terminate. Your continued access or use of the Services after such posting confirms your consent to be bound by the revised Privacy Policy Notice, as amended.
We will use personal information in accordance with the Privacy Policy Notice under which the information was collected.

CALIFORNIA CONSUMER PRIVACY ACT (CCPA) NOTICE AT COLLECTION
Under the California Consumer Privacy Act of 2018 as amended (CCPA), California consumers may be entitled to certain notices and disclosures regarding the collection and use of their Personal Information. This page is intended to provide the Notice at Collection required under the CCPA.
- We may collect personal information from you and use it for specified purposes. JobCommander, Inc. (“JobCommander”, “we” or “us”) describes in this Privacy Notice for California Consumers (“Privacy Notice”) who we are, your rights under the California Consumer Privacy Act of 2018 as amended (“CCPA”), and how we collect, use and share personal information of California residents, as provided below. We adopt this Privacy Notice in compliance with the CCPA.
Who is JobCommander?
JobCommander develops, licenses, and supports on-line job placement service to job candidates, recruiters, and employers. JobCommander may refer to itself in this Privacy Policy Notice as JobCommander and in connection with the use of the pronouns “we/us/our.”
Our on-line job placement solutions include the software as a service (“SaaS”) applications known as the JobCommander® as well as ResumeCommander. These job description postings, recruitment, job application, and placement solutions are collectively referred to as “the Services.” As a user of the Services, you may receive geo-targeted, job related alerts, notifications, requests, instructions, and information before, during, and after you post job descriptions, express interest in, and apply for jobs using the Services.
Your California Privacy Rights. The CCPA became effective on January 1, 2020 and provides consumers who reside in California with certain rights relating to their personal information.
- Right to Know – You have the right to know about the personal information which we collect and how we use and share that information.
The section of this Privacy Policy Notice entitled, what types of personal information do we collect illustrates the types of personal information which JobCommander collects.
Personal information as defined by the CCPA specifically excludes publicly available information that is lawfully made available to the general public from federal, state, or local government records. We collect or have collected in the past 12 months the following categories of personal information:
- Personal identifiers – including name, email address, postal address, IP address, telephone number
- Categories of personal information – identified in California Civil Code section 1798.80 such as name, signature, employment, and financial information
- Commercial information – such as detailed transaction information, purchase, and payment information
- Educational, professional, and employment related information – including educational institutions attended, employer, position/job title, their associated dates, and contact information
- Characteristics of protected classifications under California or federal law, such as ethnicity, race, and gender.
- Web and other network activity information (including search and browsing history)
- Inferences which reflect your behavior, derived from geolocation, your answers to questions, expressed areas of interest, and tracking data when you use the Services.
We use, share, and disclose these categories of personal information we collect from and about you consistent with our business and commercial purposes stated in the section entitled, why do we collect and for what purposes do we use personal information.
The CCPA also imposes additional obligations upon businesses that sell personal information to third parties. JobCommander does NOT sell personal information and we have not sold personal information in the last 12 months.
You also have the right to request that we disclose to you the categories and specific pieces of personal information we collect, disclose, have collected or disclosed within the last 12 months, about you; the categories of sources of such personal information, and the categories of third parties with whom we share and disclose personal information. We have described these categories previously in this Privacy Policy Notice, more particularly in the sections entitled, what types of personal information do we collect, how do we collect your personal information, and with whom do we share your personal information.
- Right to Request Correction – You have the right to request the correction of any inaccurate personal information, subject to limitations, exceptions, and conditions under the law. These include our inability to verify your identity to complete your request, your request is manifestly unfounded or excessive, or the information is publicly available, certain medical information, consumer credit reporting information, or other types of information exempt from the CCPA.
- Right to Request Deletion – You have the right to request the deletion of your personal information, subject to limitations, exceptions, and conditions under the law. These include maintaining personal information to complete transactions, to satisfy our legal obligations, to maintain security and existing functionality, to protect the free speech rights of other consumers, for research purposes that are in the public interest, and for our internal legitimate uses.
- Right to Opt-out of the Sale or Sharing of Personal Information – Under the CCPA, California consumers have the right to opt-out of the sale or sharing of their personal information with third parties for their direct marketing purposes. JobCommander does not sell, share for value, rent, or trade personal information with third parties for their direct marketing purposes as provided in the CCPA.
- Right to Limit Use and Disclosure of Sensitive Personal Information – A consumer shall have the right, subject to limitations exceptions, and conditions under the law, at any time, to direct a business that collects sensitive personal information about the consumer to limit its use of the consumer’s sensitive personal information to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
- Right to Non-discrimination – JobCommander will not discriminate against you for exercising any of your rights under the CCPA.

Please note that you will be required to verify your identity before we act upon your request. If you choose to designate an authorized agent to submit a request on your behalf, we will need to verify your identity and you must submit a written authorization signed by you for the agent to act on your behalf. The agent must be a person or entity who is registered with the California Secretary of State. We will work with you to respond within 45 days of our receipt of your verifiable request; however, we may require an additional 45 days to respond, in which case we will so advise you. The CCPA permits a California consumer to submit personal information requests no more than twice in a 12-month period.
Please note that JobCommander may maintain a confidential record of deletion requests solely for the purpose of preventing the personal information of a consumer who has submitted a deletion request from being sold, for compliance with laws, or for other purposes solely to the extent permissible under the CCPA.

Third parties, other than our vendors and service providers who support and make our Services available do not have authorization from us to track your uses of the Services or track what other activities you may have engaged in before or after using the Services (for example, using a different website). Please be advised that we cannot control third party tracking and there may be some third party tracking that occurs without our knowledge or consent.
We may provide links to web sites or services of JobCommander’s partners, distributors, suppliers, licensors and other third parties. We do not control the content or links that appear on these third party web sites or services, and we are not responsible for the practices employed by third party websites or services linked to our online or mobile content.
